The terms for buying and enjoying digital games from CodeBiters Shop.
1. Who we are
These terms govern purchases of digital video games from CodeBiters Shop, operated by Marco Ferrante CodeBiters, and the related use of customer accounts.

Please read these terms and the relevant product description before ordering. Our Privacy Policy separately explains our use of personal information. Accepting these terms is not consent to marketing or optional tracking.
2. Digital products and compatibility
We sell video games supplied as digital files, including personalized versions. Your purchase does not include a physical cartridge, disk, computer, console, or any other tangible item. There are no physical delivery charges or customs shipments.
The product page describes the supported platform, game features and any stated hardware, emulator or file-format requirements. Check these before ordering. Compatibility with unlisted systems is not promised. The description and conditions shown when you order apply to your purchase.
3. Your account
An account is required to redeem a coupon and receive downloads on CodeBiters. Sign in or create an account during checkout. For a local free order we require only your email address, first name, last name, phone number and country. Provide accurate details and keep your credentials secure.
Paid purchases currently take place on the itch.io page linked for each game. An itch.io purchase does not automatically create a CodeBiters order or unlock downloads in your CodeBiters account. The account and download arrangements presented by itch.io apply there.
You must have legal capacity to enter into the purchase contract; if you are under the applicable age of majority, a parent or guardian must make the purchase and manage the account. Contact us promptly if you suspect unauthorized access.
4. Orders, prices and payment
CodeBiters currently offers two separate routes. For a paid purchase, follow the individual itch.io purchase link for each game in your cart. Payment, any applicable taxes and delivery for that purchase are handled on itch.io under the terms shown there. The price and total displayed by itch.io at purchase apply to that transaction. We do not collect a paid checkout transaction on CodeBiters at this time.
Alternatively, apply a valid 100% discount coupon covering your entire CodeBiters cart. Only when the total is zero can you confirm a local order. No payment is collected. The free order is recorded in WooCommerce and eligible protected downloads are granted to the account used for that order. A partial discount does not enable local paid checkout.
The country collected on a free CodeBiters order is kept with the order for administration and possible future tax handling. Paid checkout tax calculations take place on itch.io; this local coupon flow does not collect tax. External purchases are not automatically synchronized with CodeBiters orders, coupons or download permissions.
5. Delivery and protected downloads
For a confirmed free CodeBiters order, standard games are available as protected download links in the order email and My Account → Downloads. Sign in with the account used for the order. The email contains links, not a game-file attachment. Games requiring personalization are prepared after order confirmation and delivered by email within 48 hours; a mixed order makes standard games available while personalized games remain in processing.
For paid purchases made on itch.io, use the download and delivery arrangements shown there. A purchase there does not automatically grant a separate download from your CodeBiters account.
If requested for personalization, provide only details you are entitled to use and do not provide sensitive information or a child’s personal information. Contact shop@codebiters.com with your order reference if a local file is missing, corrupted or does not match the agreed description.
6. License to use your game
Unless the product page or an accompanying applicable license states otherwise, your purchase grants a non-exclusive, non-transferable license to use the supplied game for your personal, non-commercial enjoyment. You do not acquire ownership of the game’s intellectual property.
You may keep a backup copy for your own use. Do not resell, publicly distribute, share the personalized game files with others, or upload them for public download unless the applicable license permits it. Any rights granted by mandatory law or an accompanying third-party or open-source license remain unaffected. Product-specific license terms must be disclosed before purchase.
7. Early digital supply and withdrawal
Standard games are supplied after order confirmation; games requiring personalization are delivered within 48 hours. Before you place an order, a separate, unselected checkbox asks for your express consent to supply the digital game before the end of any applicable 14-day withdrawal period and your acknowledgement that you lose the right of withdrawal once supply begins.
Where EU or UK distance-selling law applies, the loss of that right is conditional on the legal requirements being met, including your prior express consent and acknowledgement and the required contract confirmation. We record your agreement with the order and include it, together with a copy of the terms accepted, in your order email. Merely opening an account, paying, accepting these general terms, or starting internal personalization is not by itself treated as the required consent or as proof that digital supply has begun.
Once digital supply has begun with those requirements satisfied, you cannot cancel simply because you have changed your mind. This does not remove your rights for a game that is faulty, not supplied, or not as described.
Before that point, or where the conditions for loss of withdrawal have not been met, contact us to exercise any applicable cancellation right. Where the standard EU/UK withdrawal right applies, its period is 14 days from conclusion of the contract. You can send an unequivocal statement to shop@codebiters.com or the postal address above; the optional model below may be used but is not mandatory. Where a refund is required, it will be made using the original payment method unless otherwise agreed, within the applicable legal deadline, normally within 14 days of your withdrawal notice.
Optional withdrawal notice:
To: Marco Ferrante CodeBiters, 5985 NW 61st St, Ocala, FL 34482, United States; shop@codebiters.com
I hereby give notice that I withdraw from my contract for the following digital game(s): [game and order number].
Ordered on: [date].
Consumer’s name: [name].
Consumer’s address: [address].
Date: [date].
Signature: [only if sent on paper].
8. Faulty games, refunds and support
Contact shop@codebiters.com with your order number, platform and a description of the problem. We will work with you to investigate. Applicable remedies may include correction, replacement, a price reduction or a refund, depending on the circumstances and the law that applies.
The fact that a game is digital or personalized does not remove mandatory consumer protections. Any support or update commitments specifically included on the product page remain applicable; we do not promise lifetime updates or support for unlisted platforms.
9. Responsible use and liability
Do not misuse the website, interfere with security or other users, or provide unlawful or infringing content. We use appropriate care in providing our services, but no website or email service can be guaranteed to be continuously available.
Nothing in these terms excludes mandatory consumer rights or liability that cannot lawfully be excluded or limited. If the law of your habitual residence provides consumer protections that cannot be waived, those protections remain available. We do not require you to waive protected complaint, dispute or legal remedies.
10. Changes and contact
The terms accepted with your order apply to that purchase. Later revisions apply prospectively unless otherwise agreed or required by law. We will communicate material changes affecting any ongoing service as required by applicable law.
For questions, complaints, cancellations or support, contact us using the details below and include your order reference where available.
